Bahwa mewabahnya Covid-19 di bulan Desember 2019, membuat seluruh masyarakat dunia merasakan dampak dari penyebaran virus covid-19. Pandemi covid-19 tersebut memberikan tantangan besar pemerintah suatu Negara dalam upaya peningkatan derajat kesehatan masyarakat salah satunya Negara di Indonesia. Pemerintah berupaya memutus mata rantai penularan penyakit melalui upaya vaksinasi untuk pencegahan infeksi Covid-19. Kebijakan hukum vasinasi Covid-19 di Indonesia terkait dengan Peraturan Presiden Republik Indonesia Nomor 14 Tahun 2021 Tentang Perubahan Atas Peraturan Presiden Nomor 99 Tahun 2020 tentang Pengadaan Vaksin dan Pelaksanaan Vaksinasi dalam Rangka Penanggulangan Pandemi Corona COVID-19 (Perpres 14/2021) telah diterbitkan oleh Presiden. Vaksinasi covid-19, bertujuan untuk mengurangi transmisi/penularan covid-19, menurunkan angka kesakitan, dan kematian akibat covid-19, mencapai kekebalan kelompok di masyarakat, dan melindungi masyarakat dari covid-19 agar tetap produktif secara sosial dan ekonomi. Vaksinasi Covid-19 di saat pandemi merupakan upaya “Public Goods” yang dilakukan Pemerintah sebagai urusan wajib (Obligatory Public Health Functions), oleh karena itu seluruh biaya vaksinasi harus ditanggung sepenuhnya oleh pemerintah sebagaimana sejalan dengan Prinsip Verplichte Overheidszaken di suatu negara dalam menyelenggarakan dan atau menjalankan pemerintahan.
